By accessing, browsing, submitting information to, or otherwise using any TPIN Media platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as any policies, agreements, disclosures, or notices that are incorporated by reference. If you do not agree to these Terms, you must discontinue all use of TPIN Media services immediately.
The Power Is Now Media operates as a division of Eric Lawrence Frazier Advisory Services, a professional advisory, media, publishing, and educational enterprise. For the purposes of these Terms, references to “TPIN Media” include the parent advisory firm, all subsidiaries, divisions, brands, publications, streaming channels, podcasts, shows, magazines, membership programs, digital platforms, licensors, licensees, successors, and authorized representatives.
All content on TPIN Media platforms, including videos, audio recordings, podcasts, livestreams, graphics, photographs, written materials, articles, magazines, transcripts, digital files, branding, trade dress, logos, trademarks, service marks, advertising materials, layouts, compilations, technological frameworks, and derivative works, is the exclusive property of TPIN Media and is protected under U.S. and international copyright, trademark, and intellectual property laws. No content may be copied, reproduced, republished, downloaded, modified, distributed, broadcast, sold, or otherwise exploited without prior written permission from TPIN Media. All rights not expressly granted are reserved.
If you submit, upload, transmit, publish, or provide any written content, images, video, audio, data, comments, biographical information, or creative materials to TPIN Media in connection with show appearances, interviews, articles, or participation, you grant TPIN Media a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, publish, display, distribute, host, edit, modify, adapt, excerpt, promote, monetize, archive, and create derivative works from such submissions in any medium now known or later developed. You waive any claim to compensation unless expressly agreed in a separate written agreement. You further waive all rights relating to inspection, approval, attribution, takedown, modification, or removal of published content. This license continues indefinitely regardless of account status or participation.
By using TPIN Media platforms or appearing in TPIN Media productions, you acknowledge that TPIN Media has no obligation to remove, delete, suppress, or modify any content once published. You waive all rights to request takedowns, including under the Digital Millennium Copyright Act (“DMCA”), except where you possess a valid copyright interest unrelated to TPIN Media productions. You agree not to file DMCA takedown notices, copyright complaints, suppression requests, or legal claims seeking removal of content that TPIN Media owns. Any attempt to remove or interfere with TPIN Media content constitutes a breach of these Terms and may result in counterclaims, legal action, and the recovery of attorney fees and damages.
TPIN Media may offer paid memberships, subscriptions, consulting services, digital products, media packages, magazine subscriptions, and advisory programs. By enrolling in any paid service, you agree to all associated payment terms, renewal policies, refund policies, subscription cycles, and cancellation requirements. You authorize TPIN Media or its payment processors to charge your designated payment method pursuant to the terms of the selected service. Failure to complete payment may result in suspension or termination of access. TPIN Media does not guarantee that content or services available under a membership tier will remain unchanged or available indefinitely.
TPIN Media provides media, publishing, educational, advisory, and consumer information services. Nothing on TPIN Media platforms constitutes legal, tax, real estate, financial, investment, or professional advice unless expressly provided through a written consulting agreement executed with Eric Lawrence Frazier Advisory Services. You agree not to rely on general content as a substitute for professional consultation with a licensed attorney, CPA, real estate professional, or financial advisor. TPIN Media makes no representations regarding the accuracy, completeness, or timeliness of information provided through shows, interviews, publications, blogs, or broadcasts.
You agree that you shall not, at any time, publicly or privately, directly or indirectly, post, publish, transmit, or communicate any defamatory, harmful, negative, misleading, or disparaging statements about TPIN Media, The Power Is Now Media, Eric Lawrence Frazier, Eric Lawrence Frazier Advisory Services, any staff member, contractor, contributor, host, guest, production decision, editorial decision, or member service. This covenant applies to all communication platforms including social media, videos, blogs, podcasts, comments, messages, reviews, and third-party websites. TPIN Media reserves the right to pursue damages and legal action arising from violations of this provision.
You agree to use TPIN Media platforms only for lawful purposes and not to interfere with the rights, security, or experience of other users. You may not attempt to hack, disrupt, damage, disable, copy, extract, reverse-engineer, or misuse TPIN Media systems, content, accounts, or technological frameworks. TPIN Media may suspend or terminate access for any conduct deemed abusive, harmful, fraudulent, defamatory, or violative of these Terms.
TPIN Media content may include links to third-party websites, applications, or services not controlled by TPIN Media. You access such resources at your own risk. TPIN Media is not responsible for the accuracy, policies, content, or practices of third-party platforms. Your interactions with third parties are governed by their respective terms and conditions.
All TPIN Media platforms, services, and content are provided on an “as-is” and “as-available” basis without warranties of any kind, express or implied. TPIN Media disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, availability, uptime, and accuracy. TPIN Media makes no representations that platforms will operate uninterrupted or error-free, that defects will be corrected, or that servers or systems are free of harmful components. You assume all risks associated with the use of TPIN Media’s services.
To the fullest extent permitted by law, TPIN Media, Eric Lawrence Frazier, and all related entities shall not be liable for any damages arising from your use of TPIN Media platforms or services, including indirect, incidental, consequential, punitive, or special damages, whether based on contract, tort, negligence, strict liability, or any other theory. Your sole remedy for dissatisfaction with TPIN Media services is to discontinue use.
You agree to indemnify, defend, and hold harmless TPIN Media and Eric Lawrence Frazier Advisory Services from all claims, losses, damages, liabilities, costs, or attorney fees arising out of your use of TPIN Media platforms, your breach of these Terms, your submission of content, your conduct in connection with TPIN Media services, or your violation of the rights of any third party. This obligation survives termination of your account or use.
Your continued use of TPIN Media platforms constitutes acceptance of these Terms. Where applicable, your digital signature, including your typed name, IP address, timestamp, and “I Agree” selection, is legally binding under federal law. You waive any right to deny or repudiate your assent to these Terms.

These Terms are governed exclusively by the laws of the State of California. The exclusive venue for any dispute, claim, or legal proceeding shall be the state or federal courts located in Riverside County, California.
